SEC investigating Reuters' early release of ISM data

The Securities and Exchange Commission is investigating the relationship between the news organization Thomson Reuters and the Institute for Supply Management, CNBC has learned.

The two entities join forces to publish market-moving manufacturing data that is generated by ISM and published to high-speed data clients by Thomson Reuters.

CNBC reported earlier this month that ISM's manufacturing data was inadvertently sent out early by Thomson Reuters on June 3 to its high-speed clients, many of whom immediately traded on the information.

There was a sharp market reaction to that burst of trading, which prompted downward moves in the SPY ETF, which serves as an investing tool for traders to bet on the overall direction of the market. That downward surge came 15 milliseconds ahead of the official release time for the data. In an era of super-fast computer trading, 15 milliseconds is more than enough time to profit from early knowledge of market moving information.

ISM CEO Thomas Derry told CNBC Thursday that the SEC reacted to that report by asking Thomson Reuters for a copy of its contract with ISM. The two organizations released a redacted form of the contract to the SEC, Derry said. "The SEC did speak specifically to Thomson Reuters about our relationship," Derry said. "We have not been contacted by any government entity."

Derry said that in the wake of the incident ISM has spoken to Thomson Reuters about the mechanics of the release of data, and he's satisfied that the situation will not be repeated. "We have to be smart enough with our partners to manage the process appropriately so we're not giving anyone a running start," he said. "I'm very confident that Thomson Reuters has put itself in a place for no more repeat of the premature release," he said.

A spokesperson for Thomson Reuters did not immediately respond to a request for comment. A spokesman for the SEC declined to comment.

The June 3 incident was spotted by an analyst at Nanex LLC, who alerted CNBC to it. Nanex data show as many as 30,000 shares of SPY traded in 1 millisecond during the course of the 15 millisecond gap between the inadvertent release and the official public dissemination of the information that day. In addition, Nanex said it saw downward moves in 369 stocks during the 15 milliseconds. All told, Nanex calculated that $28 million worth of shares were exchanged in a short time before the official release of the ISM data.

US Cellular and NQ Mobile strike deal to provide security apps to customers

Two branded security apps to help keep customer's smart phone data safe

In an effort to offer better comprehensive security to its customers, U.S. Cellular announced today that it will partner with NQ Mobile to provide security apps to its 5.2 million customers. The partnership expands on a previous program that offered an app called "NQ Family Guardian" to customers, with two new apps called "U.S. Cellular Mobile Data Security powered by NQ Mobile™" and "U.S. Cellular Privacy Protector powered by NQ Mobile™". The apps will be free in the Play Store as branded options limited to the carrier's customers.

Together the apps aim to give customers protection from viruses, malicious URLs and other outside threats along with a security suite that offers secure encryption for photos, videos and other data users want to keep safe. On their own, NQ Mobile's self-branded versions of the apps have done well in the Play Store with high ratings and reviews, so U.S. Cellular certainly seems to have made a good choice here.

In an interview with various news outlets marking today?s anniversary, he said that even if Sweden were to drop its investigation into sex allegations against him, he plans to stay put. That means London faces the prospect of an unusual guest for years to come.

"I wouldn't say I wouldn't leave," he said. But "my lawyers have advised me I shouldn't leave the embassy because of the risk of arrest and extradition to the United States."

Mr. Assange?s plight has drawn in equal measure support and disdain. Some call him a criminal and danger to security, others a crusader of freedom of information. And those same divides are apparent within the United Kingdom itself: just read the comments section of any Guardian article on the Wikileaks head, and the range of views are obvious.?

But it appears the UK, after a year hosting Assange, does not want another leaker in its midst. Britain last week warned global airlines not to let Edward Snowden, the American contractor who identified himself as the source of the leak about widespread American surveillance programs called PRISM, into British territory. And this was before Mr. Snowden released documents showing British intelligence spying on foreign diplomats at a G20 in London in 2009.

Assange linked Britain?s position on Snowden?to his own, saying the country "doesn't want to end up with another Julian Assange," he said. Yet, Assange said, the UK should consider Snowden a hero and offer him asylum.

That?s not something that Britain was willing to do for Assange, who walked into the Ecuadorean embassy last June after the British government said it would send him to Sweden, where he faces questioning over sexual assault and rape. Assange, who maintains his innocence in that case, says his real fear is being extradited to the US for being behind one of the biggest leaks of confidential documents in US history.

Ecuador has granted Assange asylum, but he cannot leave the embassy in London because Britain promises to arrest him if he does. Recent talks between Ecuador and the UK did nothing to end the stalemate. So the status quo remains: Assange living without natural sunlight, relying on a sun lamp instead, and working 17-hour days in front of his computer, he says, with police on constant guard. He?s likened his circumstances to living in a space station.

Assange is not the only one to compare himself to Snowden. After Snowden answered questions on an online chat this week, Zeke Miller, in Time, draws parallels between the two men.??There were other clear echoes of Assange?s?past remarks?in Snowden?s responses Monday. Both men suggest that much, if not all, American spying abroad is wrong, including the spying on allies and foreign leaders that perhaps every government has practiced for decades, if not centuries,? Miller writes.

Assange has drawn critics who fault him for putting global security at risk, but also has his share of detractors who distinguish the issue of Wikileaks from the separate sex allegations he faces.

Snowden, meanwhile, has gotten some support in Britain for leaking information about PRISM, says?Orla Lynskey, a lecturer in law at the London School of Economics and Political Science. ?What really struck people here was the disproportionate nature of that kind of intelligence, the blanket surveillance,? Ms. Lynskey says. ?That?s where Snowden gets some support.?

Judge taking no action in Jackson guardianship

LOS ANGELES (AP) ? A judge said Tuesday that he will make no changes to the guardianship of Michael Jackson's three children after receiving an investigator's report on their well-being and meeting with attorneys for their caretakers.

Superior Court Judge Mitchell Beckloff ordered the inquiry after 15-year-old Paris Jackson was hospitalized on June 5. Authorities reported she took Motrin pills and cut her arm with a kitchen knife.

The judge ordered an investigator to interview Jackson's children and report back to him.

Beckloff also met with attorneys for the children's guardians, grandmother Katherine Jackson and their adult cousin TJ Jackson.

"I'm taking no further action," Beckloff told attorneys for Jackson' estate.

The decision was announced during a hearing at which Howard Weitzman, an attorney for the estate, raised the issue of potential harm to the singer's daughter that might come with unsealing "salacious details" of a choreographer's recent molestation allegations against the pop superstar.

Beckloff told attorneys he will consider which portions of Wade Robson's complaint to unseal and inform attorneys of his decision. Robson claims the acts occurred when he was a child.

Another hearing will be held to determine if Robson can pursue that allegation.

Perry Sanders Jr., an attorney for Katherine Jackson, has said Paris Jackson is physically fine and receiving proper medical attention. He has not provided further updates on her condition.

"In light of all current circumstances and the special investigator's report, we agreed with the judge that appropriate decisions are being made regarding care of all three children, and no further action is required," Sanders wrote in a statement Tuesday.

Hiding in plain sight: New species of bird discovered in Cambodia's capitol Phnom Penh

June 25, 2013 ? A team of scientists with the Wildlife Conservation Society, BirdLife International, and other groups have discovered a new species of bird with distinct plumage and a loud call living not in some remote jungle, but in a capital city of 1.5 million people.

Called the Cambodian tailorbird (Orthotomus chaktomuk), the previously undescribed species was found in Cambodia?s urbanized capitol Phnom Penh and several other locations just outside of the city including a construction site. It is one of only two bird species found solely in Cambodia. The other, the Cambodian laughingthrush, is restricted to the remote Cardamom Mountains.

Scientists describe the new bird in a special online early-view issue of the Oriental Bird Club?s journal Forktail. Authors include: Simon Mahood, Ashish John, Hong Chamnan, and Colin Poole of the Wildlife Conservation Society; Jonathan Eames of BirdLife International; Carl Oliveros and Robert Moyle of University of Kansas; Fred Sheldon of Louisiana State University; and Howie Nielsen of the Sam Veasna Centre.

The wren-sized gray bird with a rufous cap and black throat lives in dense, humid lowland scrub in Phnom Penh and other sites in the floodplain. Its scientific name ?chaktomuk? is an old Khmer word meaning four-faces, perfectly describing where the bird is found: the area centered in Phnom Penh where the Tonle Sap, Mekong and Bassac Rivers come together.

Only tiny fragments of floodplain scrub remain in Phnom Penh, but larger areas persist just outside the city limits where the Cambodian Tailorbird is abundant. The authors say that the bird?s habitat is declining and recommend that the species is classified as Near Threatened under the IUCN?s Red List. Agricultural and urban expansion could further affect the bird and its habitat. However, the bird occurs in Baray Bengal Florican Conservation Area, where WCS is working with local communities and the Forestry Administration to protect the Bengal florican and other threatened birds.

This same dense habitat is what kept the bird hidden for so long. Lead author Simon Mahood of WCS began investigating the new species when co-author Ashish John, also of WCS, took photographs of what was first thought to be a similar, coastal species of tailorbird at a construction site on the edge of Phnom Penh. The bird in the photographs initially defied identification. Further investigation revealed that it was an entirely unknown species.

?The modern discovery of an un-described bird species within the limits of a large populous city ? not to mention 30 minutes from my home ? is extraordinary,? said Mahood. ?The discovery indicates that new species of birds may still be found in familiar and unexpected locations.?

The last two decades have seen a sharp increase in the number of new bird species emerging from Indochina, mostly due to exploration of remote areas. Newly described birds include various babbler species from isolated mountains in Vietnam, the bizarre bare-faced bulbul from Lao PDR and the Mekong wagtail, first described in 2001 by WCS and other partners.

Colin Poole, Director of WCS Singapore and a co-author of the Forktail study said, ?This discovery is one of several from Indochina in recent years, underscoring the region?s global importance for bird conservation.?

Co-Author Jonathan C. Eames of BirdLife International?s OBE said: ?Most newly discovered bird species in recent years have proved to be threatened with extinction or of conservation concern, highlighting the crisis facing the planet?s biodiversity.?

Steve Zack, WCS Coordinator of Bird Conservation, said, ?Asia contains a spectacular concentration of bird life, but is also under sharply increasing threats ranging from large scale development projects to illegal hunting. Further work is needed to better understand the distribution and ecology of this exciting newly described species to determine its conservation needs.?
